Using Florida statute 553.79 to close out old building permits

How to use Florida Statute 553.79 to close out old building permits?

This is something which the Florida Association of Realtors got changed. As of 7 June 2019 via HB 447 local governments are, as per FS 553.79(16) & (17), to…

  • Authorized to close a building permit six years after the issuance of the permit if the local government determines that no apparent safety hazards exist.
    • 16 (c) A local enforcement agency may close a building permit 6 years after the issuance of the permit, even in the absence of a final inspection, if the local enforcement agency determines that no apparent safety hazards exist.
  • Prohibited from penalizing an “arm’s length purchaser” of property solely because a previous owner failed to close a building permit.
    • “(17)(a) A local enforcement agency may not deny issuance of a building permit to; issue a notice of violation to; or fine, penalize, sanction, or assess fees against an arms-length purchaser of a property for value solely because a building permit applied for by a previous owner of the property was not closed. The local enforcement agency shall maintain all rights and remedies against the property owner and contractor listed on the permit.”

It also provides remedies for owners who subsequently discover permits that remain open for work they previously contracted for, and for new purchasers who later discover an open permit for improvements added by a previous owner of the property that was previously undisclosed.

It is important to note that a contractor hired to finish an original contractor’s uncompleted work are only liable for the work they perform. The new contractor is not responsible for any defects in the work performed by the original contractor.

Palm Beach County 2025 TRIM Notice

On 08/21/2025 , The Palm Beach County Property Appraiser mailed the 2025 TRIM or Truth in Millage notice. If you want to know what your proposed property valuation is then this is what it’s all about. This is your chance to file a notice to contest that proposed valuation with the VAB This is the start date for the time line to file that. Florida law sets the deadlines for filing a petition on or before the 25th day following the mailing of the TRIM notice from our office. This year’s deadline is September 15, 2025. Remememer that the FY 2025 valuation is set on 1 Jan 2025 and thus based upon “qualified” sales in 2024.

It will also give you a range of your estimated tax bill based upon various millage rates like last years, and the “roll back” numbers. If you want to see the MAX number, based on last years millage rates, without waiting by the mailbox you can look up your property on PAPA.

Hometown Heroes Housing Program Reopens

Eligible first-time buyers can receive up to $35K for down payments and closing costs through the Hometown Heroes Housing program, a Florida Realtors’ priority.

TALLAHASSEE, Fla. — A new application period for Florida’s Hometown Heroes Housing program is underway, offering eligible first-time buyers much-needed funds toward a down payment and closing costs on a new home. During the most recent legislative session, Florida Realtors® successfully advocated for an additional $50 million in funding for the program.

Applications for the popular program opened Monday for up to 5% of the total first mortgage loan amount (maximum of $35,000/minimum of $10,000) towards down payment and closing costs for frontline and essential workers. The Florida Legislature included the new “first-responder” occupation restrictions this year to ensure those employed in critical service roles have a chance at obtaining the homebuying assistance before the money runs out.

For the 2025-2026 fiscal year, eligibility for financial assistance through the program appropriated shall be limited to the following borrowers:

• A person employed full-time by a Florida-based employer as a health care worker, school staff member, first responder, public safety or court employee, or child care worker;

• A service member of the United States military or military reserves, the United States Coast Guard or its reserves, or the Florida National Guard; or

• A veteran employed full-time by a Florida-based employer.

Where is the best place to buy in Florida and snow bird to Boston or New York?

I grew up in Boston and now live in the Jupiter area. The answer is an easy one for me and it all has to do with my ease and expense of getting back and forth between these two homes. And where am I in Florida. That answer is simple. Jet Blue and the Palm Beach International Airport (PBI) in West Palm Beach. Jet Blue has cheap, numerous flights back and forth from Boston, JFK and Newark. PBI is, in my opinion, the easiest airport I’ve every flown in/out of. From Jupiter it’s about 20 minutes or so away and let’s face it, Jupiter is a terrific place to live. Golf, boats, a HUGE public beach, shops reastaurants and easy access to West Palm Beach.

My quick cabinet upgrade for white shaker style doors

What I did was…

  • Pull the doors.  I replaced mine.

  • Clean cabinets with alcohol.  I bought a gallon and put in it a sprayer.  Clean & degrease the cabinets first.
  • Fill and sand if required and clean again
  • Tape off with the good green frog tape.

For most people, buying or selling a house is one of the most complicated financial transactions of a lifetime. Recently, we did BOTH, in a matter of months. Fortunately, we had Chris Ryder and his firm R&R Realty to work with, making the process as smooth as possible. At the beginning, we were absolute rookies, knowing nothing about the process, with a hundred questions, every day. Chris ALWAYS had time for us, communicating via phone, text, or email with me (Steve) and phone with Victoria, whatever we were most comfortable with. His knowledge of the Palm Beach County market (we sold our condo there) and beyond (we bought a condo in Martin County) is comprehensive. And his resources, from photographer, inspector, escrow, and mortgage broker are just as professional and thorough as he is. The staging of our condo for the listing photographs was wonderful! Chris is also a licensed contractor and an engineer, giving him expertise that other agents do not have.
