What are 55+ communities?
These are communities which, basically, are allowed to discriminate based upon age as to who lives in them IF, and only if, they follow certain rules. These rules are spelled out in the Housing for Older Persons Act or HOPA. Click HERE to read what the HUD Frequently Asked Questions are on this. The rules are many and folks are always trying to side step them but the basic requirements are:
a) at least 80 percent of the occupied units must be occupied by at least
one person 55 years of age or older per unit;
b) the owner or management of the housing facility/community must
publish and adhere to policies and procedures that demonstrate an
intent to provide housing for persons 55 years or older; and
c) the facility/community must comply with rules issued by the
Secretary for verification of occupancy through reliable surveys and
affidavits.
Keep in mind that the above HUD Rules are a MINIMUM and the condominium or Home Owners Association (HOA) could have in place more restrictive rules and in those instances the more restrictive rule (as long as it’s legal) of the recorded covenants or duely adopted Rules & regulations would prevail.
Because 55+ restricted housing units are typically less expensive folks are always trying to get an exception to that 20% of residents who can be under 55. These are typically reserved for the spouse or descendants of owners. The 54 year old widow of the now deceased 56 year old husband can stay in the home.
