FinCEN changes to Far Bar As-Is Contracts in Florida

There are new FinCEN reporting requirements for certain case sales in Florida and the thus the Far Bar As-Is was just updated with this:

“FinCEN REAL ESTATE REPORTING OBLIGATION. Section 1031.320 of Chapter 31 of the Code of Federal Regulations (“CFR”) requires that certain residential real estate transactions without institutional lender financing, where at least one buyer/transferee is a legal entity, limited liability company, corporation, partnership, trust, trustee or other non-natural person, must be reported to the U.S. Treasury Department’s Financial Crimes Enforcement Network (“FinCEN”) beginning March 1, 2026 (a “FinCEN Report”). If this transaction requires completion of a FinCEN Report, then Seller and Buyer shall, no later than the day prior to Closing, provide Closing Agent with all information and documentation necessary to enable Closing Agent to complete the FinCEN Report. Such information and documentation includes, without limitation, full legal names, dates of birth, residential street addresses, and the IRS taxpayer identification number of the beneficial owners of the parties, as further defined and described in the CFR. Each party agrees to promptly provide and consents to Closing Agent’s collection and report of said information to FinCEN. Buyer shall pay all costs and fees charged by Closing Agent to prepare and file the FinCEN Report.”

Can I buy a waterfront house in North Palm Beach to rent out the house and use the slip myself? The answer to this quesyion was always no. In North Palm Beach, one had to be the occupant of the property to use the adjacent dockage. So that was the Owner, or the Tenant, who lived at that property. But then the Village got sued and the person won. The basics of that case are that the owner of the property bought property in the Village, fixed up the dockage, and put a boat behind the house but he did not live there and the boat was not owned by his Tenant.

“The Court declares that the term “occupant” in Code § 5-81’s definition of Private dock, pier, mooring buoy and floating anchor means the person that occupies title or the premises.”

Can I buy a house and a slip in Twelve Oaks in North Palm Beach to rent the house and use the slip myself? Yes! If one buys (or owns) a house in Twelve Oaks and owns a slip in the Marina then one can use the slip and rent out the house. BUT one can not rent the slip to anyone who does not reside in the community.

The Marina at Twelve Oaks in North Palm Beach is a terrific place to keep a boat. The slips have power and a fire extinguisher system. And BONUS, you can have a lift. It has mostly 40 and 50 ft slips wiht a few 80 ft avalable as well.

For most people, buying or selling a house is one of the most complicated financial transactions of a lifetime. Recently, we did BOTH, in a matter of months. Fortunately, we had Chris Ryder and his firm R&R Realty to work with, making the process as smooth as possible. At the beginning, we were absolute rookies, knowing nothing about the process, with a hundred questions, every day. Chris ALWAYS had time for us, communicating via phone, text, or email with me (Steve) and phone with Victoria, whatever we were most comfortable with. His knowledge of the Palm Beach County market (we sold our condo there) and beyond (we bought a condo in Martin County) is comprehensive.
