New (2025) Florida Condominium Rider REQUIREMENTS and right to cancel

06/25/25 – Note that the laws on this just changed and the timelines for condominiums to complete the reports has been EXTENDED. You may read about these changes HERE. Basically though: “The new law, which will take effect July 1, includes extending the deadline for Structural Integrity Reserve Study (SIRS) to Dec. 31, 2025, and narrows the application of both the milestone inspection and SIRS studies from three stories or more, to three habitable stories or more. It also allows for a temporary pause in reserve funding for two years immediately following a milestone inspection, thus providing a longer timeline for associations that need it. Additionally, it gives condo associations flexibility on meeting reserve requirements and allows associations to use lines of credit to satisfy reserve obligations if a majority of owners approve.”

Now requires that the Seller disclose if the condoiminium:

  • is the condominium if required to, and has completed a, milestone inspection report as described in Section 553.899, F.S.
  • is required to and has completed a turnover inspection report for a turnover inspection performed on or after July 1, 2023, as described in Section 718.301(4)(p) and (q), F.S.
  • is required to and has completed a structural integrity reserve study as described in Sections 718.103(28) and 718.112(2)(g), F.S.

And if the Buyer requestes these documents then the Seller must provide them and the Buyer MAY GIVE WRITTEN NOTICE OF THE BUYER’S INTENTION TO CANCEL WITHIN 3 DAYS, EXCLUDING SATURDAYS, SUNDAYS, AND LEGAL HOLIDAYS, AFTER THE DATE OF EXECUTION OF THIS AGREEMENT BY THE BUYER AND RECEIPT BY BUYER OF A CURRENT COPY OF THE INSPECTOR-PREPARED SUMMARY OF THE MILESTONE INSPECTION REPORT AS DESCRIBED IN SECTION 553.899, FLORIDA STATUTES, IF APPLICABLE;

So, basically, if the condominium has a milestone inspection report, and/or a turnover inspection report, and/or a structural integrity reserve study then, similar to the condo documents langauge, IF the Buyer requests these then the they must be provided by the Seller. If the Buyer does not like what they find in those reports then they can cancel the Contract within 3 business days of receipt of these requested reports.

Who pays the fee for the Closing Agent in Florida – 2025

If you had to Google the answer to this then you need to work with someone who knows these things. Call me, Chris Ryder, at 561.818.3858.

First, the short answer is that the Check box found in Paragraph 9(c) (Seller or Buyer pays…) of the Far Bar As-Is ONLY dictates who pays for the Owner’s Title Policy and the Municiple Lien Search. Other than these 2 items the Buyer or Seller ir responsible for the “Charges” delineated under Paragraph 9(a) or 9(b). And for the Buyer AND the Seller that includes a Closing Fee.

This just changed. Historically, the party that chooses the Closing Agent pays their fee. Thus, the Closing Agent was paid by the party that chose to use them which was a check box on the Contract. In a cash sale where the Seller chose, and the Seller paid, the Buyer would NOT pay a Closing Fee. BUT in a sale with financing and where the Seller chose the Closing Agent and paid the fee to close THE SALE, the Buyer would still pay a fee to the Closing Agent, justified by them, as being required to close the loan. It was a fight. But now the Closing Cost section SPECIFICALLY states the “Buyer’s Closing Services” as a fee ascribed to the that party.

And the Contract includes a definition of: “Closing Services” shall have the meaning ascribed to that term in Section 627.7711(1)(a), F.S.; each party shall bear their own Closing Services fees payable to Closing Agent or such other provider(s) as each party may select.

And it looks to me like the FS refferenced is to close the sale BUT not the loan. The Buyer should ALWAYS ask RIGHT AWAY how much the Closing Agent will charge the Buyer and the Seller to 1) close the transaction and 2) the fee to the Buyer to close the loan, assuming they are using one.

The FS referenced reads: “(1)(a) “Closing services” means services performed by a licensed title insurer, title insurance agent or agency, or attorney agent in the agent’s or agency’s capacity as such, including, but not limited to, preparing documents necessary to close the transaction, conducting the closing, or handling the disbursing of funds related to the closing in a real estate closing transaction in which a title insurance commitment or policy is to be issued.”

New Year, New Condo Rules

Starting Jan. 1, condo sale contracts must include conspicuous statements about the milestone inspection, turnover report and structural integrity reserve study.

ORLANDO, Fla. — A new year, another condominium law. We ring in this new year with a 2023 condominium law that created a future deadline for sales contracts entered into after December 31, 2024, to include new statutory language. Here’s what you need to know.

The law

Starting on January 1, 2025, contracts for the sale of a condominium require statements to be included in conspicuous type regarding the milestone inspection (Milestone), turnover inspection report (Turnover), and structural integrity reserve study (SIRS). There are three scenarios that require a statement:

  1. If the Association is required to complete the Milestone, Turnover, and SIRS on or after July 1, 2023, and the Association has not completed them;
  2. If the Association is not required to complete the Milestone, Turnover, and SIRS; or
  3. If the Association is required to complete the Milestone, Turnover and SIRS on or after July 1, 2023, and the Association has completed them.

The law also states that a contract for the sale and purchase of a condo that does not meet these new requirements is voidable at the option of the buyer prior to closing. Thus, it is important for a seller to provide accurate answers to the buyer about these three documents as it pertains to these scenarios, so the buyer does not exercise their potential right to terminate the contract.

Updated forms

To ensure that the parties are complying with the law, both the Florida Realtors®/Florida Bar (FR/BAR) A. Condominium Rider (CR-7_A) (“Condo Rider”) and the Contract for Residential Sale and Purchase (CRSP) Condominium Addendum F (CRSP16xxxx_F) (“Condo Addendum”) have been updated with the new required language. These forms can be found on Form Simplicity.

The updated Condo Rider and Condo Addendum present the seller with a series of checkboxes to fill out for each of the Milestone, Turnover and SIRS documents. The seller will need to check the appropriate boxes that correspond to one of the three scenarios listed above. The seller will need to contact their Condo Association regarding the status of these documents to be able to appropriately fill out this new section of the form. If a seller is unsure how to complete this new section or the form, then the seller will need to seek legal advice.

What is a No Brokerage Relationship disclosure in Florida?

Florida has long had 3 basic types of agency relationships between real esate consumers and licensees: Single Agency Broker, Transactional Broker and a No Brokerage realtionship. Currently all consumers are ASSUMED to be acting in a Transactional Broker relationship with the agent UNLESS AND UNTIL another form of agency is entered into such as the No Brokerage Relationship which specifies that:

As a real estate licensee who has no brokerage relationship with you,   (insert name of Real Estate Entity and its Associates)   owe to you the following duties:

1. Dealing honestly and fairly;

2. Disclosing all known facts that materially affect the value of residential real property which are not readily observable to the buyer.

3. Accounting for all funds entrusted to the licensee.

For most people, buying or selling a house is one of the most complicated financial transactions of a lifetime. Recently, we did BOTH, in a matter of months. Fortunately, we had Chris Ryder and his firm R&R Realty to work with, making the process as smooth as possible.
