Legal Hotline: How Should I Field Multiple Offers?

It’s rewarding to see pre-listing work pay off when a seller receives multiple offers – but now what? There are many options with just a few rules to keep in mind. Here’s one that’s true across the board: Be honest.

A great article on multi offer situations including the note that “As for the terms contained in any given offer, there is no default obligation of confidentiality. So, unless a buyer has included a specific confidentiality agreement with the offer, the seller is typically allowed to share the details of that offer with whomever the seller chooses.”

Condo Q&A: Amending Documents, Bylaws and Boards

Is it acceptable for a condo association to “self-insure” and cancel their current insurance? Also: Can a board avoid naming a director to an empty position?

Question: My cooperative dock association board of directors is exploring the ability to “self-insure” by cancelling the wind coverage on the docks and increasing the reserves. The present windstorm insurance is almost half of the annual budget and is effectively useless due to the deductible. The board thinks they can do this by amending the governing documents to remove the insurance requirement. Can this be done?

Answer: Probably not. While the governing documents can be changed by an amendment, the documents cannot be changed to circumvent the requirement of the Cooperative Act. Specifically, F.S. 719.304(3) which requires a cooperative association to insure all association property. In a cooperative, the association “owns” the docks and leases them to the members. So, the statutory requirement that the association insure “association property” includes the “docks” even though Statute 719.104(3) does not literally use the word docks.

The Cooperative Act also allows an association to “self-insure” as an alternative to traditional insurance. However, “self-insurance” is not simply maintaining reserves. It is controlled by Florida Statute 624. To boil it down, it requires the association to essentially create its own insurance company and fund it. It is extremely complex and cost prohibitive in the sense of the actual savings.

Update to how to calculate the Citizens Wind Storm Mitigation credit

OK, so I recently decided to re-visit an old post I did on how to calculate the annual wind storm credit Citizens Insurance gives if I say install shutters or install impact rated windows. To do this one must look at the mitigation credits form AND something called the “Mitigation Factors” tables in the Citizens underwriting manual.

First, print out and review the form required to request these credits…

Use this form and the tables below to determine if an upgrade to your home will yield a wind storm mitigation credit. For instance if every window in your home has Level A protection EXCEPT your front entry door then if you changed this out you will get the full “A” mitigation credit for this section. The cost for this may be $1000 but the mitigation credit could be almost 40% off your annual premium of $4,000 or $1,600 A YEAR in savings.

Let’s assume that the policy is for wind storm only and a single family home. One would then look at the table:

If one has a non FBC roof (very old now as this would be pre 2002) with Level A attachment roof sheathing, toe nailed truss/rafter connections and no secondary water proofing BUT you added Class B shutters (and doors and sky lights) protection then this would reduce your base premium by 1-0.71 or 29%. And, if you went to Class A then it would be reduced by 39%.

July 2020 Jupiter Palm Beach Gardens Housing Sales

The RAPB+GFLR just released the July 2020 housing sales numbers and it shows what we on the ground know. Product is flying off the proverbial shelf. Locally here that’s folks from the northeast, and north in general, moving to the area. I can live for the next year in a small house worth 2M up north or I can live in a palace in Jupiter for the same money. Oh, and Florida doesn’t have an income tax.

Can I build a guest house on my property in Caloosa?

Caloosa is located in an unincorporated area of Palm Beach County to the west of Palm Beach Gardens and Jupiter in the Agricultural Residential Zoning District (AR) with a Rural Residential – 10 Future Land Use.  Lots in the AR Zoning District are considered conforming with a measurement of 300 width x 300 length.  ALL lots in Caloosa are 5 acres so they meet this dimension requirement so we look at Table 3.D.1.A for setbacks and lot coverage.

NOTE that there are 2 different types of accessory structures:

  1. Accessory dwellings with a kitchen.
  2. Guest Cottage with NO kitchen.

Jupiter Farms has non conforming lots so they’re a bit different.

Where the lots in Caloosa are all 5 acres and thus conforming to the current zoning district then the property may have EITHER of these structures, as long as they meet the required setbacks in Table 3.D.1.A. AND subject to the approval of the Caloosa HOA association.

BTW, ALL building heights are governed by Chapter 3 of the ULDC and that limits height to 35′ to the mean roof height in Article 3.

Closing delays and the Consumer Finance Protection Bureau Closing Disclosure

Can a real estate closing be delayed because the Buyer has not been provided with a Closing Disclosure? In short yes.

2021 update. I will focus on the FAR BAR As-Is Contract effective 1 Nov 2021 as that is what is used in Florida for 90% of all transactions. The applicable paragraph is:

The first question is: Is paragraph 8(b) checked? Is the transaction subject to financing approval. If your reading this then I suspect it is yes. Has Loan Approval been obtained? Is the lender’s underwriting complete? One can not use this to extend the Closing for further underwriting review or because (insert story). It may only be used if the CFPB requirements are applicable AND not yet satisfied and may only extend the Closing Date for 7 days.

The CFPB Requirements state that the consumer (Buyer/Borrower) must have the CD at least 3 business days prior to the date the consumer is scheduled to sign the loan documents and note that this date may or may not be the Closing Date if the Buyer is a “mail away” closing.

Read this for the items which will require a new CD to be issued.

Note that it can only be extended as “necessary to satisfy CFPB Requirements” and then only for 10 days and that’s 10 calendar days.

For most people, buying or selling a house is one of the most complicated financial transactions of a lifetime. Recently, we did BOTH, in a matter of months. Fortunately, we had Chris Ryder and his firm R&R Realty to work with, making the process as smooth as possible.
