What will I need for insurance

I get this question often:  Chris, what will I need for insurance?

First, the easy answer.  If you do not have a mortgage then you don’t ‘need’ any insurance.

If you do not have a mortgage then you do not have to have the following but you really should consider if the risk if worth it.  If the property is financed then your lender will require:

1) A Home Owners Policy for things like fire, water leaks, theft and liability.  Liability is really what your after here for most of us.  You should consider this for detached homes as well as condominiums and town homes.  This policy typically covers NON-named storms.

2) A named windstorm policy for named storms a/k/a hurricanes.  This is the big ticket item and can run several thousand dollars a year.  If your home was built after 2002 (under the 2001 Florida Building Code) you’re in good shape.  If it was built prior to 2002 you should apply for wind mitigation credits for things like hurricane shutters.  The best time to do this is at the property inspection.  Ask you insurance agent for the forms.  These credits can save you as much as 70% of the unadjusted premium.

If your buying a property in a condominium then it almost certainly has a named wind storm policy however keep in mind that this policy ONLY COVERS THE ASSOCIATION PROPERTY.  This is typically from the unfinished floors and walls outward.  So this policy would cover the structural elements and the drywall but not the flooring, paint, light fixtures, carpet, tile, CABINETS & COUNTERS, etc.

3) A flood insurance policy.  These are for floods or when the water comes up from below into your property.  If you’re in a condo then probably only the first floor is affected.  If you have a mortgage then it is required if the property is in an ‘A’ Zone AND the living space is below a certain elevation.  To determine the flood zone the property is in go to the FEMA web site https://msc.fema.gov/portal/

Then you will need an elevation certificate which is done when the property is surveyed if it’s a single family home or a town home.  If it’s a condo then the agent may be able to determine if a policy is required by your lender by looking at the association policy.

Don’t forget that these policies are paid for in advance.  If you are financing the purchase then the premium is collected at the Closing and the policy paid.  Then the lender collects 1/12 of the renewal premium every month.

While I’m certainly not a fan of insurance I can see why a lender would require it and why it’s something we all should consider the necessity of having in place.

I listed the home at 2354 Treasure Isle Drive in the gated Mariner’s Cove subdivision.  This is the ONLY home around the lake in the community for sale.  Why?  It’s a terrific place to live.  The best of ALL worlds.  A secure gated waterfront community on the intracoastal just minutes from the Juno beaches and super convenient location on Prosperity Farms Rd.  Why pay the big taxes of a waterfront home?  This property includes in the sale a deed 35′ slip, perfect for up to a 30′ boat right across the street from the home.  The slip is a littoral area ownership so your would actually own the land under the water.

Do-it-yourself deed causes problems for homeowner

I saw this in a Realtors Q&A and thought it might be of interest…

Question: Several years ago, my brother and I bought a foreclosed house from the bank. He and I split the money, but only my name went on the deed. We downloaded a form off the Internet, creating a limited liability company and quit-claim deeding the property to our company. We just found out that the bank missed a lien during the foreclosure. We made a claim against our title insurance policy that was denied. What gives? – Charles

Answer: A title insurance policy is bought at closing to cover exactly this type of problem: an unknown defect or challenge to your ownership of the house.

But title insurance is a contract with the insurer, just like any other insurance policy. There are rules that have to be followed and exceptions to the coverage. Your problem is caused not only by the fact that you transferred ownership of the property to a separate legal entity, but also by the type of deed that you used to do it.

A quit claim deed only transfers ownership and provides no promises that the ownership is good – or even that your seller will help fix any problems that come up. You should have instead used a warranty deed, which contains these promises.

It may be tempting to save a few bucks by handling these matters yourself, but even a seemingly innocent mistake can cause you big trouble later.

It’s cheaper to live in Fla. than Northeast

Contrary to some consumer perceptions, it’s cheaper to live in Florida than most of the Mid-Atlantic and Northeast states, according to a Washington, D.C.-based think tank.

A study by the Tax Foundation showed that $100 in Florida buys $101.21 worth of goods, based on the national average. In the Northeast, only Pennsylvania, Rhode Island and Maine stretched their dollars further.

$100 in New York only buys $86.66 worth of goods, according to the report. The D.C. area is the nation’s most expensive, with $100 only getting $84.60.

The figure is a statewide average. However, as the Clearwater Gazette reported, prices spike near cities, and Florida is no exception – but prices in and around Tampa are still cheaper than New York City and Boston.

And in Florida there’s no Income Tax.

WOW! 55+ Restriction NOT applicable to a forclosure sale

I saw this on a FAR Q&A…

Question: I live in a 55-and-over condominium. A neighboring property recently was sold at a foreclosure auction to a young couple who moved in with their small children. This goes against the rules of our community. Is there anything we can do? – Anonymous

Answer: No. When the sale of a unit occurs by legal action, such as in a foreclosure or to an heir in a probate case, it is outside of the boards authority to approve or deny, similar to the way federal law will take precedence over state law. But just because the new owners get to live there without the boards consent, it does not mean that they will get a free pass for other association rules, including the requirement that they eventually sell or rent the condo to someone who is at least 55.Typically, 55-and-over communities require only 80 percent of the residents to meet the age restriction. The 20 percent cushion is in place to accommodate situations such as foreclosure and the death of a spouse whose widow or widower is younger than 55.

For most people, buying or selling a house is one of the most complicated financial transactions of a lifetime. Recently, we did BOTH, in a matter of months. Fortunately, we had Chris Ryder and his firm R&R Realty to work with, making the process as smooth as possible. At the beginning, we were absolute rookies, knowing nothing about the process, with a hundred questions, every day.
